Reporting a Accident or “Incident”

We just recently came across a situation were a worker was assigned duties they were not normally assigned, the result was a gradual onset of pain. Like most good workers this employee felt “I have two shifts left; I’ll work through the discomfort.”

The worker had trouble sleeping on Sunday night, Monday morning he called his supervisor to explain and let the Company know he was seeking medical attention. Medical was sought and modified duties prescribed. Certainly from our position the worker acted in a responsible manner. read more


Weekly Indemnity Benefits


Weekly Indemnity benefits shall commence to accrue on the first calendar day of disability due to an injury or the eighth calendar day due to illness. If the employee is hospitalized for at least 24 hours, admitted and assigned a hospital bed or the disability is due to an illness which a surgical procedure has been prescheduled on an out patient or day care surgery basis, benefits shall commence to accrue on the first day of disability.


If an employee suffers from an accidental injury and is wholly and continuously disabled as a result of the accident the benefits kick in on the first day. read more


Filing a Claim

Under the act benefits are payable for “personal injury by accident arising out of and in the course of employment”. There are two types of injuries sudden and gradual.

A sudden injury is the result of a chance event, most of us would think of this as an accident. However it important to have a very broad mind with regards to an accident. The act states benefits are payable for any work related personal injury. This would also include a gradual onset injury. That would be an injury which would be brought about over a period of time due to a repetitive action or movement. read more


Continuity

We are fielding quite a few calls on “I had an injury a number of years ago” from our members wishing to pursue further entitlements under that claim.

If that injury resulted in a NEL (non-economic loss award) then the “door” remains open when the condition deteriorates above the award level, or you aggravated that body part to the point of requiring medical treatment. That could include therapy’s, medications or entitlement for a reassessment to their NEL. read full story
